Shot By — Terms of Service and Privacy Policy

PLEASE READ THESE TERMS OF SERVICE (“AGREEMENT” OR “TERMS OF SERVICE”) CAREFULLY BEFORE PURCHASING OR USING ANY PRODUCTS OFFERED BY SHOT BY. THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR PURCHASE AND USE OF THE SHOT BY WEBSITE AND ALL RELATED SERVICES, INCLUDING, WITHOUT LIMITATION, ANY FEATURES, CONTENT, WEBSITES, FILES, DOWNLOADS OR PORTALS OFFERED FROM TIME TO TIME BY SHOT BY IN CONNECTION THEREWITH (COLLECTIVELY “SERVICE(S)”). BY MAKING A PURCHASE OR USING THE SERVICES IN ANY MANNER, YOU AGREE TO BE BOUND BY THIS AGREEMENT.

“The Site” refers to the website and any subpages operated by Shot By, as well as associated applications, services, features, content, and functionalities offered by Shot By (including the customer portal accessible via this page →).

Acceptance of Terms of Service

The Service is offered subject to acceptance without modification of all these Terms of Service and any other operating rules, policies and procedures that may be published from time to time by Shot By. In addition, some materials or future features may be subject to additional terms and conditions issued by Shot By from time to time; your use of those features is subject to those terms, which are incorporated here by reference.

Shot By may, in its sole discretion, refuse to offer its Services to any person or entity and may change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Service is revoked in such jurisdictions.

Scope of Service

Shot By provides digital products (“Frameworks”, “Packs”, “Downloads”, “Files”) for creative and educational use. These products are sold as one-time purchases that grant the buyer permanent access to the materials available at the time of purchase and to any future updates added to the same product category. Buyers can access their files at any time through the customer portal on this page → /framework.

Shot By does not offer subscription services or recurring charges. Each purchase grants lifetime access to the digital files and associated updates as advertised at the time of sale.

Eligibility

By purchasing from or using Shot By, you confirm that you are at least 18 years old (or the legal age of majority in your country of residence). If you are under 18 or do not meet the minimum age of digital consent in your country, you are prohibited from purchasing or using the Service.

It is your responsibility to ensure that your use of Shot By’s products complies with local laws and regulations regarding digital commerce and content licensing.

Purpose and Appropriate Use

Shot By’s digital packs and prompt frameworks are intended for lawful and ethical creative use only. By purchasing and using any pack, you agree NOT to use the materials to:

Create or distribute defamatory, fraudulent, misleading, or deceptive content.
Promote illegal activities, violence, discrimination, or hate speech of any kind.
Produce or assist in any form of pornographic, exploitative, or adult content.
Repurpose, resell, or redistribute Shot By’s original files or pack materials in any format.
Create false documents or representations for fraudulent purposes.
Use Shot By’s content to train AI models or automated systems without written permission.

The files and prompts included in Shot By products may only be used for creating original work for personal or commercial purposes, as permitted under these Terms.

User Conduct and Responsibilities

By accessing and downloading materials from Shot By, you agree to:

Comply with all applicable laws and regulations.
Use the materials only for lawful purposes.
Maintain the confidentiality of your login information and account details.
Refrain from copying, modifying, reselling, or publicly sharing any Shot By files or downloads.
Avoid any use of the Service that could damage, disable, or interfere with the website or portal.

If you violate these rules, Shot By may immediately terminate your access to all materials without refund and may take legal action where appropriate.

Content Ownership and Copyright

All Shot By files, packs, and prompt kits remain the intellectual property of Shot By. Purchasing a digital product grants you a non-exclusive, non-transferable license to use the materials as described herein. You do not own the copyright or intellectual property of the underlying content.

Any unauthorized resale, distribution, or publication of Shot By materials is a violation of international copyright law and may result in legal action.

Modification of Terms of Service

At its sole discretion, Shot By may modify or replace any of these Terms of Service at any time by posting a revised version on this page. Your continued use of Shot By materials after any update constitutes your acceptance of the revised Terms.

Shot By may also update its products, pricing, or portal access structure without notice. If you disagree with any change, your sole remedy is to discontinue use of the Service.

License and Usage Rights

Upon completing your purchase from Shot By, you are granted a personal and commercial use license to the files, materials, and content provided within your purchased pack.
This license allows you to:

Use the included materials, prompts, and templates for your own projects or for clients.
Incorporate the materials into creative, commercial, or marketing work you produce.
Modify or adapt the materials for your own creative use.

This license does not allow you to:

Resell, share, or redistribute the files or prompt frameworks in their original or modified form.
Upload the files or prompts to any public platform, database, or resale marketplace.
Sub-license, rent, or transfer access to your Shot By account or materials.
Use Shot By content to train AI systems, build competitive datasets, or generate derivative commercial products that compete with Shot By.

All rights not expressly granted remain with Shot By.

Access to the Frameworks

Each product is a subscription based purchase.
You gain access to all included and future updates associated with that product, for as long as your subscription lasts, accessible through this page → /framework.
Shot By reserves the right to maintain, modify, or discontinue file delivery systems at its discretion, provided that alternative access is made available if required.

Your access is tied to the email address used during purchase. You are responsible for keeping that address active and up to date.

Account Responsibility

You are solely responsible for maintaining the confidentiality of your login details for the portal and any activity conducted under your account.
You may not share your login credentials or allow others to access your purchased materials.
If Shot by detects shared or resold access, we may immediately revoke access without refund and block future purchases.

Restrictions

By purchasing and using Shot by materials, you agree not to:

Use the content for unlawful, defamatory, or deceptive purposes.
Imply that Shot By endorses your work without written permission.
Use the materials in a way that violates any intellectual property, privacy, or publicity rights.
Circumvent or attempt to bypass any access control measures on the website or portal.
Reverse-engineer, scrape, or automate data extraction from Shot by’s website or storage systems.

You agree to use the content only in accordance with applicable copyright, trade, and data protection laws.

Intellectual Property Ownership

All files, text, imagery, graphics, prompt formulations, layout designs, and digital product structures provided by Shot by are protected by international copyright and intellectual property laws.

Unless otherwise specified in writing, all trademarks, service marks, and logos displayed on Shot by materials or the website are owned by Shot by and may not be used without express written permission.

Any unauthorized reproduction or commercial distribution of these materials is strictly prohibited and will result in immediate termination of your rights under this Agreement, along with potential legal action.

Fair Use and Attribution

While you are not required to credit Shot by when using results generated from our materials, you may not falsely claim authorship of the original prompt packs or templates.
If you publicly reference or showcase work made using Shot By packs, we appreciate—but do not require—attribution in a professional context (e.g. “created with Shot By”).

You may not represent Shot by, its team, or its products as your own or use its brand name for marketing without written consent.

Trademarks

All Shot By names, logos, and product designations are trademarks or registered trademarks of Shot By.
Other brand names or marks that may appear within examples or promotional content remain the property of their respective owners and do not imply endorsement.

Violation of Terms

If you breach any provision of these Terms, including resale, redistribution, or misuse of Shot by materials, your access and license will terminate immediately without refund.
Shot By reserves the right to restrict access to the portal, block purchases, or take legal action to enforce its intellectual property rights.

Payments

All payments to Shot by are processed securely through trusted third-party platforms such as Stripe or CheckoutPage.
By completing a purchase, you agree that:

The price listed at checkout is final and inclusive of all files and access related to that specific product.
You authorize Shot By (and its payment partners) to process the transaction using the payment details you provide.
All prices are shown in the applicable currency stated at checkout and may vary slightly depending on your payment provider’s exchange rate or processing fees.

Shot By does not store or have direct access to your payment card details.

Refund Policy

All purchases are final and non-refundable.
Upon payment, you receive full access to all digital materials, and therefore no withdrawal or refund right applies.

By purchasing from Shot by, you acknowledge and agree that:

Digital files are delivered immediately after payment.
You waive any right to a cooling-off or withdrawal period.
Refunds, chargebacks, or partial credits will not be issued for any reason, including accidental purchases or change of mind.

If you encounter an issue accessing your files, you may contact support, and we will assist in restoring your access.

Delivery and Access

After successful payment, you will receive confirmation by email with instructions to access your frameworks through this page.
All content is digital; no physical shipments occur.

Access is tied to the email address used during checkout.
If you change your email address, contact Shot by support to update your account.

Termination of Access

Shot by reserves the right to suspend or permanently revoke your access if:

You violate these Terms of Service.
You share, resell, or distribute Shot by materials to others.
You use Shot by content in an unlawful, misleading, or damaging way.

If your access is revoked for violating these terms, no refund will be issued.

Shot by may also terminate access to any product or the entire portal if required by law, technical necessity, or at its sole discretion, provided that customers are given reasonable alternative access to previously purchased materials.

Disclaimers

All Shot by products are provided “as is” and “as available.”
Shot by makes no warranties or guarantees, express or implied, including but not limited to:

That any material will meet your specific expectations or creative outcomes.
That downloads will always be uninterrupted, timely, secure, or error-free.
That results obtained from the use of Shot by materials will be accurate, complete, or profitable.

You agree that your use of all Shot by materials and files is at your own discretion and risk.

Limitation of Liability

To the fullest extent permitted by law, Shot by and its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to:

Loss of income, business, or data;
Loss of opportunity, goodwill, or reputation;
Errors, omissions, or interruptions in the availability of materials;
Any damages resulting from unauthorized access to your account or data.

In no event shall Shot by’s total cumulative liability exceed the amount you paid for the specific product that gave rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Shot by, its affiliates, and their respective directors, contractors, and representatives from all claims, losses, liabilities, or expenses (including legal fees) arising out of:

Your misuse of Shot by products or materials;
Your violation of these Terms or any applicable law;
Any third-party claim related to your use of Shot By materials.

Shot by reserves the right to assume exclusive defense of any matter otherwise subject to indemnification by you.

No Guarantee of Results

Shot by provides creative resources and digital materials to assist your work but does not guarantee any specific business, creative, or financial outcome.
All examples shown on the website or in promotional material are for demonstration only.
You acknowledge that results vary based on your individual use, skill, and context.

Miscellaneous

These Terms constitute the entire agreement between you and Shot by and supersede all prior communications, proposals, or understandings—whether oral or written—related to your use or purchase of Shot by products.

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary so the rest remains in effect.
Failure by Shot by to enforce any provision is not a waiver of its right to enforce these Terms later.

You may not transfer or assign any rights or obligations under these Terms without Shot by’s written consent.
Shot by may transfer or assign its rights or obligations in the event of a sale, merger, or reorganization.

No partnership, joint venture, employment, or agency relationship is created by these Terms.
All notices must be in writing and sent by email to the address provided by each party.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict-of-law principles.
You agree that any dispute or claim arising from or relating to Shot By, its products, or these Terms will be governed exclusively by Dutch law.

Dispute Resolution by Binding Arbitration

Please read this section carefully. It affects your legal rights.

You and Shot by agree that any dispute, claim, or controversy arising out of or relating to these Terms, your purchase, or your use of Shot by’s products will be resolved exclusively through final and binding arbitration before a neutral arbitrator instead of a court.
By agreeing to these Terms, you waive your right to a jury trial or to participate in any class action.

The arbitration will be conducted by a neutral arbitrator in accordance with the rules of the Singapore International Arbitration Centre (SIAC).
The arbitration may be conducted in person in Singapore or remotely, as agreed by both parties.
Each party will bear its own costs, except where otherwise required by law.

The arbitrator’s decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court with jurisdiction.

Either party may seek temporary or preliminary relief in a court of competent jurisdiction to protect its rights or property pending the outcome of arbitration.

Prohibition of Class and Representative Actions

You and Shot by agree that each may bring claims against the other only in an individual capacity, not as a plaintiff or class member in any class, consolidated, or representative action or proceeding.
The arbitrator may not consolidate claims or otherwise preside over any form of a representative or class proceeding.

Opt-Out Option

You may opt out of this arbitration provision within thirty (30) days of your first purchase by sending a written notice to:

Include your name, the email address used for purchase, and a clear statement that you wish to opt out of mandatory arbitration.

Opting out of arbitration does not affect the rest of these Terms.

Limitation Period

To the fullest extent permitted by law, you agree that any claim or cause of action arising out of or related to your purchase or use of Shot by materials must be filed within one (1) year after the event giving rise to such claim.
After one year, all claims are permanently barred.

Waiver of Jury Trial

If any dispute proceeds to court instead of arbitration, you and Shot By expressly waive any right to a jury trial.

Severability

If any part of this arbitration agreement is found invalid or unenforceable, that part will be modified to the minimum extent necessary to make it valid, and the remaining provisions will remain in effect.
If the prohibition on class actions is deemed invalid, the entire arbitration agreement will be void, but the rest of these Terms will continue to apply.

Changes to These Terms

Shot by may modify these Terms at any time by posting an updated version on this page.
The updated version will include a new effective date at the top.
Continued use of the products or portal after changes become effective constitutes acceptance of the revised Terms.
If you do not agree with the new Terms, you must stop using the Service.
